The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026. It is the most significant piece of nicotine and tobacco legislation in a generation. Most coverage focuses on the generational smoking ban. But several provisions apply directly to nicotine pouches, and the dates and details matter enormously for anyone who uses or sells them.
This guide explains exactly what changes, when each provision takes legal effect, and what it means in practice. Every date in this article has been verified against the Act itself, ASH's official timeline, and primary government sources including legislation.gov.uk and GOV.UK official guidance published up to July 2026.
THE MOST IMPORTANT THING TO KNOW: NICOTINE POUCHES ARE NOT BANNED
Let's start here, because it is the question behind almost every search that will lead someone to this page.
The Tobacco and Vapes Act 2026 does not ban nicotine pouches. There is no nicotine pouch ban in this Act, and there is no proposal for one. Adults in the UK can continue to buy and use nicotine pouches legally, exactly as they do today. The generational sales ban, one of the Act's most headline-grabbing provisions, applies exclusively to tobacco products: cigarettes, hand-rolling tobacco, cigars, pipe tobacco, and heated tobacco products. Nicotine pouches contain no tobacco leaf, so they fall completely outside the scope of this ban. A person born on or after 1 January 2009 can never legally be sold a cigarette as they grow older. That same restriction does not apply to nicotine pouches.
Plain English: if you can legally buy a nicotine pouch in the UK today, the generational tobacco ban will not change that. Ever. It applies to tobacco products only.
What the Act does do is bring nicotine pouches into the same regulatory category as vapes for the first time, applying rules around age verification, advertising, and eventually a registration scheme. These are guardrails, not bans. Here is what they mean.

THE 18+ AGE LIMIT: NOT YET LAW, BUT COMING
This is the detail that most coverage gets wrong, and it matters. As of today, July 2026, there is no UK statutory minimum age of sale for nicotine pouches. Responsible retailers, including UK Pouch Store, enforce 18+ as a matter of policy. But it is a policy choice, not a legal requirement. That changes on 29 October 2026, when the Act's six-month commencement period expires.
From that date, selling a nicotine pouch to anyone under 18 will be a criminal offence, with the same legal weight as selling cigarettes or alcohol to a minor. Trading Standards will have powers to enforce this, and retailers face fines for non-compliance.

THE ADVERTISING BAN: CONFIRMED FOR 1 JUNE 2027
The Government confirmed on 1 June 2026, in a written statement to Parliament by the Department of Health and Social Care, that the advertising and sponsorship ban for vaping and nicotine products will take effect across the UK on 1 June 2027.
This applies to nicotine pouches. From that date, the kind of high-visibility marketing that nicotine pouch and vape brands have used in recent years, promotional sponsorships, paid advertising campaigns, and similar, will no longer be legal.
The ban includes a defence for advertising campaigns undertaken on behalf of a public health authority, so NHS stop smoking campaigns and similar are unaffected.
Crucially, this does not restrict retailers from listing products on their websites, providing product descriptions, or helping adult customers choose the right strength or flavour. It restricts paid promotion aimed at acquiring new customers, not factual product information.
Key point: the advertising ban is about marketing and sponsorship - not about whether you can display or describe nicotine pouches for sale. You can. Product information is not advertising.
PACKAGING AND FLAVOURS: NEW CONSULTATION JUST LAUNCHED
On 13 July 2026, the Government launched a public consultation on restricting the packaging, flavour descriptors, and product appearance of vaping and nicotine products. This consultation is the next and most commercially significant step in the Tobacco and Vapes Act's regulatory programme.
The consultation proposes restrictions on:
- Flavour descriptors and names on packaging (e.g. whether a product can be labelled 'Tropical Mango' or 'Blue Raspberry')
- Colour and design of product packaging, to reduce visual appeal to young people
- In-store display restrictions, similar to the tobacco display ban introduced in UK supermarkets in 2012
This is important to understand clearly: these are proposals at consultation stage. Nothing has been decided, no ban is confirmed, and no implementation date exists. The consultation closes later in 2026, and any restrictions would require further secondary legislation before taking effect.
Current flavours, currently stocked by UK Pouch Store, remain entirely legal. There is no confirmed date on which any flavour will be banned. We will update this page as the consultation process develops.
WHAT ABOUT THE VAPING PRODUCTS DUTY?
The Vaping Products Duty (a separate piece of legislation from the Tobacco and Vapes Act) takes effect on 1 October 2026. Nicotine pouches are not subject to this duty. The Government consulted on whether to include them and decided against it.
This means that from October 2026, the price of vaping products will increase meaningfully, approximately £2.64 per 10ml once VAT is included, while the price of nicotine pouches will not change as a result of this duty. We have a separate guide covering this in full.
WHY IS THIS HAPPENING?
The regulatory gap around nicotine pouches has existed because the category grew faster than the law could keep pace with. Pouches appeared on the UK market without the decades of regulation that govern cigarettes, and without being classified as vaping products either. They occupied a genuine legal grey area.
The Tobacco and Vapes Act 2026 closes that gap by formally classifying nicotine pouches as consumer nicotine products, alongside zero-nicotine vapes, and applying broadly similar regulatory standards: age restrictions, advertising controls, and eventually a registration scheme.
The government's own stated aim, consistent across all official communications, is to preserve these products as an accessible option for adult smokers and vapers looking for an alternative, while closing routes to underage access. The UK approach is explicitly harm-reduction based, this is what distinguishes it from the outright bans introduced in France, Belgium, and the Netherlands.
WHAT DOES THIS MEAN FOR YOU AS A POUCH USER?
- Now until 29 October 2026: no changes to what you can buy or how. Continue as normal.
- From 29 October 2026: age verification at checkout becomes a legal requirement everywhere. If you buy from UK Pouch Store this already happens on every order.
